Kells publican ordered to pay €5,353 + costs for illegal Sky broadcast

Following successful legal action taken by Sky for showing Sky Sports programmes illegally in a commercial premises, Sean Farrelly, licensee of Smith’s Bar in John Street, Kells, Co Meath, has been ordered to pay €5,352, plus Sky’s legal costs.

Officially recorded on 26th September after an earlier ruling at Trim Circuit Court, an injunction was granted against Sean Farrelly, restraining him from showing sports events using a domestic viewing card.

He was ordered to pay the damages after he was found to have infringed Sky’s copyright by showing Sky Sports in his pub without a valid commercial viewing agreement. The order was recently served.

Sky continues to crack down on publicans here who continue to show Sky in their pubs without the correct commercial viewing contract.

Alison Dolan, Deputy Managing Director at Sky Business, commented, “This case demonstrates the seriousness of this issue, as courts continue to deliver considerable penalties to licensees who televise Sky content illegally. Licensees without a commercial viewing agreement, who are using any system that allows access to matches to which Sky has exclusive rights in Ireland, will face legal action.

“We remain committed to protecting the thousands of hardworking licensees who invest in Sky Sports to build their businesses and entertain their customers. ”
