Judge fines man €300 for failure to wear mask in a c-store

A 48-year-old man who refused to wear a mask in court last week was told by the judge to “stop your nonsense”.

A Garda at Ennis District Court handed a disposable mask to Jonathan O’Gorman after Judge Mary Larkin requested he wear one. However, O’Gorman declined the mask, saying “these things are poisonous” and instead partially covered his face with the red hoodie he was wearing.

Jonathan O’Gorman was appearing in court to contest a charge relating to his failure to wear a mask in a Centra store in Corofin, Co. Clare on 17 February.

O’Gorman was convicted of the offence and fined €300 by Judge Mary Larkin.

When in the witness box, he told Judge Larkin that having to wear “a face mask violates [the] personal rights of a citizen to breathe fresh air, to shop, to travel to and from the State and not be questioned regarding private health matters”.

He added that the wearing of masks created the conditions for onset of respiratory issues, most notably runny nose, stuffy headache and shortness of breath. “Such symptoms are recognised symptoms of Covid 19 and I declare that the wearing of a face mask in any setting gives me Covid-19.”

He added that his GP would not give him an exemption from wearing a face mask on the grounds that he is a fit and healthy man.
