Alliance for Insurance Reform has called for awards for minor personal injuries to be reduced by 80%

It is understood that new judicial guidelines on damages for personal injuries – to replace the Book of Quantum – are due to be considered by the Judicial Council this Friday, 5 February, independent retailers’ group RGDATA reports. Following the adoption of the guidelines, they will then be published on the Judicial Council website.

The Judicial Council is scheduled to adopt and publish new judicial guidelines on damages for personal injuries by 31 July at the latest.

The Alliance for Insurance Reform (AIR) has called on the judiciary to have regard to the common good in their deliberations and reduce awards for minor personal injuries by 80% – a call which is supported by RGDATA.

“What we award for minor, fully recovered injuries in Ireland is 4.4 times higher than in England and Wales and further multiples higher than other European jurisdictions,” said AIR director Peter Boland.

“An 80% reduction on minor injuries would only bring us down to where England and Wales currently are and would still be nowhere near the equivalent damages in other European countries,” he added, pointing out that England and Wales are also set to further slash their damages for minor whiplash injuries later this year.”
